Terms and conditions regarding tax and customs duties


1. Transportation fee

  1. The sender agrees to pay the shipping charges to MySafe at the rates announced by the company or as shown on the invoice on the date of export.
  2. The above transportation charges do not include any customs duties, import taxes, VAT, local taxes or any other fees levied by government or customs authorities in the destination country, which are the responsibility of the sender or recipient as required by law, unless there is a clear written agreement that the service is DDP (Delivered Duty Paid).

2. Customs duties and fees

2.1 DDU (Delivered Duty Unpaid)

  • The sender or consignee is responsible for paying any customs duties, taxes and fees associated with the import of goods.
  • MySafe is not responsible for paying any taxes or fees on behalf of you unless authorized in writing.
  • If the recipient or sender fails to pay the tax/duty within 3 business days after being notified, the package may be abandoned or returned at the sender's expense.

2.2 DDP (Delivered Duty Paid)

  • MySafe may assess and collect taxes/duties in advance from the sender based on the product information and value provided by the sender.
  • If the sender provides incorrect information (e.g., misrepresentation of value, under-declaration, or misclassification of goods), destination customs reserves the right to impose additional taxes, fines, and fees.
  • The sender agrees to be solely responsible for such costs.

3. Responsibility for payment

  1. The sender is ultimately responsible for paying all costs associated with the parcel, whether or not collected from the recipient.
  2. If the outstanding balance is 3,000 baht or more, MySafe reserves the right to immediately suspend service until the sender has paid the outstanding balance in full.
  3. These Terms and Conditions will continue to apply until the Sender notifies MySafe in writing of their request to cancel their use of the DDP/DDU Service and receives written confirmation of their cancellation from MySafe.
  4. Cancellation shall not affect any rights, duties or liabilities of the Sender arising before the effective date of cancellation, which the Sender shall remain liable for until fully paid.
  5. MySafe reserves the right to take legal action to collect the outstanding debt, together with interest at the rate prescribed by law or at the rate determined by MySafe (as applicable), including other costs related to enforcement.

4. Notification and payment of debt

  1. MySafe will send billing notifications via email, text message (SMS), AMS, application or any other online system that the sender has registered with MySafe. Notifications through such channels shall be deemed to have been received by the sender legally and are binding upon completion of the sending to the contact information provided by the sender.
  2. The Sender must pay all amounts in Thai Baht (THB) unless otherwise agreed in writing. Payment must be made in full, without any deductions or fees, except as agreed in writing by MySafe.

5. Exceptions to MySafe's Liability

  1. MySafe shall not be liable for any loss, damage, delay, confiscation, return of packages or any other damages arising from (1) the sender's or recipient's failure to pay duties and taxes on time, (2) inaccurate, incomplete or misleading information about the goods, (3) decisions, measures or controls of customs or government agencies in the country of origin or destination, and (4) any other similar causes beyond MySafe's control.
  2. If MySafe is liable in any way, MySafe's liability shall be limited to the extent permitted by law or not exceeding the limit.

Compensation under the applicable insurance contract (if any), whichever is lower, is accepted by the sender as a material limitation of liability for the use of the Service.

6. Enforce the law

  1. This Agreement shall be governed exclusively by the laws of Thailand and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Thai courts in the Kingdom of Thailand.
  2. MySafe's failure to exercise any right or remedy under this Agreement in any particular case, or any waiver granted by MySafe to the Sender, shall not be deemed a waiver of MySafe's right to exercise such right in the future, nor shall it waive MySafe's right to enforce this Agreement in any other case.
